Protective Covenants and Restrictions

For Sixth Addition and replat of lots 9 & 10 to Fort WM. Symington

January 24th, 1992

 A. Each lot to be used for residential purposes only.  Minimum residence requirement shall be 1500 square feet, exclusive of garage.

B. No fences, walls, or hedges, shall be erected or maintained between street and front setback line of any lot.

C. Temporary structures may be erected for use in connection with the actual construction of a residence.  But no such temporary structure shall remain on any lot for a period langer than 120 days.

D. No mobile homes shall be allowed.

E. All camp trailers, motor homes, boats or boat trailers shall be parked to rear of house setback line.

F. Garbage, trash, junk, etc. to be disposed of in a sanitary, lawful and proper manner.  No undesirable objects, “part vehicles”, etc., creating a visual distraction in such a manner as to annoy the occupant of other lots shall be permitted or allowed to exist on any lot.

G. No “dish” antennas to be in front yard.

H. No Real Estate or other signs to be over 18 inches by 24 inches.

I. Each owner of a lot has the right to lake access through a 20 foot easement on the southwesterly side lot 4 of replat of 9 and 10 of division 6, designated thereon as a drainage easement.  Boat trailers shall not be parked on this easement.

J. Each owner of a lot in division 6 shall participate in a Homeowners Association.  Each owner of a lot shall have the right of enjoyment in and to the common areas of Lake William Symington which shall pass with the title to every lot subject to the following provisions:

  1.  The right of the Lake Symington Community Club to charge a reasonable annual fee of which as of this date is $36.00 per year, for the purpose of maintenance of common areas of Lake William Symington.
  2. Every owner of a lot which is subject to homeowners dues shall be a member of the association.
  3. Each owner of a lot within said subdivision by acceptance of a deed is subject to covenants and restrictions and agrees to pay the association an annual homeowners dues, as established and collected as herein after provided.
  4. Any homeowners dues not paid within thirty days after the due date shall bear interest at a reasonable rate.  A lien of the homeowners dues not paid within thirty days after the due date shall bear interest at a reasonable rate.  A lien of the homeowners dues provided for, may be placed against the property if unpaid.

The right and title to all mineral and oil rights shall remain in the Dave Symington Trust.

These Covenants are to run with the land with the land and shall be binding on all parties and all persons claiming under them.

Invalidation of any one of these covenants by judgment or court order shall ein no way affect any of the other provisions which shall remain in full force and effect.

Enforcement shall be by proceeding at law or in equity against any person or persons violation or attempting to violate any covenant either to restrain violation or recover damages.
